By accessing and using ATMA (Automated Trade Management Assistant), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
ATMA (Automated Trade Management Assistant) is an automated trading management system designed to assist with options trading strategies. The service provides:
- Automated trade execution through brokerage API integration (e.g., Tradier)
- Strategy development and backtesting tools
- Position monitoring and management
- Performance analytics and reporting
- Daily volatility forecasts and market analysis
- Email and SMS notifications for trades, forecasts, and account activity
- Discord integration for trade notifications
- Real-time dashboard and analytics
ATMA acts as an intermediary between you and your brokerage account through API integration. You maintain full control over your trading account and can disable automation at any time.
3. Risk Disclaimer
IMPORTANT: Trading options involves substantial risk of loss and is not suitable for all investors. You should carefully consider whether trading is suitable for you in light of your circumstances, knowledge, and financial resources.
- Options trading can result in the loss of your entire investment
- Past performance does not guarantee future results
- You may lose more than your initial investment
- Market conditions can change rapidly and unpredictably
- Technical issues, system failures, outages, or technology malfunctions may result in unintended trades, missed trades, or financial losses
- System outages or technology failures may prevent trade execution, stop-loss orders, or other automated actions, potentially resulting in significant financial losses
- Technology systems are unpredictable and subject to failures beyond our control
- You assume all risks associated with relying on automated trading systems and technology infrastructure
4. User Responsibilities
You are responsible for:
- Maintaining the security and confidentiality of your account credentials
- All trading decisions and their consequences
- Ensuring your API keys and account information are kept secure
- Monitoring your positions and account balance regularly
- Configuring notification preferences appropriately (email/SMS)
- Managing your subscription and account settings
- Complying with all applicable laws and regulations
- Using the service in a lawful manner
- Providing accurate information when creating and maintaining your account
5. API and Brokerage Integration
ATMA integrates with brokerage APIs (such as Tradier) to execute trades on your behalf. You acknowledge that:
- You are solely responsible for all trades executed through your account
- ATMA is not responsible for brokerage API limitations or failures
- You must have appropriate trading permissions with your brokerage
- API rate limits and restrictions may affect trade execution
6. No Financial Advice
ATMA provides tools and automation services only. ATMA does not provide investment, financial, legal, or tax advice. All trading strategies and decisions are your own. You should consult with qualified financial advisors before making investment decisions.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The service may be unavailable due to maintenance, technical issues, or circumstances beyond our control. We are not liable for any losses resulting from service unavailability.
IMPORTANT: While we are working to implement failover systems and redundant AWS infrastructure to minimize downtime, such systems may not be fully operational at all times. Service interruptions may occur without notice, and we are not responsible for any consequences resulting from such interruptions.
7.1 System Outages and Technology Failures
CRITICAL DISCLAIMER: Technology systems, including cloud infrastructure, APIs, networks, and software, are inherently unpredictable and subject to failures, outages, bugs, errors, and malfunctions. You acknowledge and agree that:
- System Outages: ATMA may experience system outages, downtime, or service interruptions due to various factors including but not limited to:
- Cloud infrastructure failures (including AWS service outages, region failures, or instance failures)
- Network connectivity issues or internet service provider problems
- Third-party API failures (brokerage APIs, notification services, etc.)
- Software bugs, errors, or malfunctions
- Hardware failures or data center issues
- Cybersecurity incidents, attacks, or breaches
- Maintenance, updates, or upgrades
- Natural disasters, power outages, or other force majeure events
- Regulatory or legal actions affecting service providers
- No Guarantee of Uptime: ATMA does not guarantee 99.9% uptime, continuous availability, or uninterrupted service. Service may be unavailable at any time for any duration without prior notice.
- Financial Losses: You expressly acknowledge and agree that ATMA shall not be liable for any financial losses, trading losses, missed trading opportunities, or any other damages of any kind (direct, indirect, incidental, consequential, or punitive) resulting from:
- System outages, downtime, or service interruptions
- Technology failures, bugs, errors, or malfunctions
- Delayed or failed trade executions
- Missed stop-loss orders, profit targets, or other automated actions
- Data loss, corruption, or inaccuracy
- Notification delivery failures (email, SMS, Discord, push notifications)
- API communication failures or timeouts
- Inability to access your account or trading dashboard
- Technology is Unpredictable: You understand that technology systems are complex and unpredictable. Despite our best efforts to maintain reliable systems, failures can and will occur. You assume all risks associated with relying on automated trading systems and technology infrastructure.
- No Warranty: ATMA provides the service "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.
- Your Responsibility: You are solely responsible for monitoring your trading positions, account balance, and market conditions. You should not rely solely on ATMA's automated systems and should maintain your own monitoring and risk management practices. You are responsible for all trading decisions and their consequences, regardless of whether ATMA's systems are operational.
- Future Improvements: While we are working to implement failover systems, redundant AWS instances, and improved reliability measures, such improvements may not be available immediately and do not guarantee uninterrupted service. The implementation of such systems does not create any obligation or warranty regarding service availability.
BY USING ATMA, YOU EXPRESSLY ACKNOWLEDGE THAT YOU UNDERSTAND AND ACCEPT THE RISKS ASSOCIATED WITH TECHNOLOGY FAILURES AND SYSTEM OUTAGES, AND YOU AGREE THAT ATMA SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES RESULTING FROM SUCH FAILURES OR OUTAGES, REGARDLESS OF THE CAUSE OR DURATION.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
SPECIFIC LIMITATIONS REGARDING SYSTEM OUTAGES AND TECHNOLOGY FAILURES:
- ATMA SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSSES, TRADING LOSSES, OR INVESTMENT LOSSES RESULTING FROM SYSTEM OUTAGES, TECHNOLOGY FAILURES, SERVICE INTERRUPTIONS, OR ANY OTHER TECHNICAL ISSUES, REGARDLESS OF WHETHER SUCH ISSUES WERE FORESEEABLE OR PREVENTABLE.
- ATMA SHALL NOT BE LIABLE FOR ANY LOSSES RESULTING FROM FAILED OR DELAYED TRADE EXECUTIONS, MISSED TRADING OPPORTUNITIES, OR INABILITY TO ACCESS THE SERVICE DURING MARKET HOURS OR AT ANY OTHER TIME.
- ATMA SHALL NOT BE LIABLE FOR ANY LOSSES RESULTING FROM CLOUD INFRASTRUCTURE FAILURES (INCLUDING AWS OUTAGES), NETWORK ISSUES, API FAILURES, SOFTWARE BUGS, DATA CORRUPTION, OR ANY OTHER TECHNOLOGY-RELATED PROBLEMS.
- ATMA SHALL NOT BE LIABLE FOR ANY LOSSES RESULTING FROM NOTIFICATION DELIVERY FAILURES, INCLUDING BUT NOT LIMITED TO FAILED EMAIL, SMS, PUSH NOTIFICATIONS, OR DISCORD MESSAGES.
- IN NO EVENT SHALL ATMA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE EXCEED THE AMOUNT YOU PAID TO ATMA IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
- THE FOREGOING LIMITATIONS SHALL APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ATMA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOU EXPRESSLY WAIVE ANY RIGHT TO RECOVER DAMAGES FROM ATMA ARISING OUT OF OR RELATING TO SYSTEM OUTAGES, TECHNOLOGY FAILURES, OR SERVICE INTERRUPTIONS, REGARDLESS OF THE CAUSE OR DURATION OF SUCH ISSUES.
9. Account Termination
9.1 Termination by You
You may terminate your account at any time by:
- Using the "Delete Account" feature in Settings → Security (permanent deletion)
- Contacting support at support@atmatrader.com or (833) 408-9321
Account Deletion: When you delete your account, all associated data will be permanently removed, including trades, balance history, settings, and personal information. This action is irreversible.
9.2 Termination by Us
We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, non-payment of subscription fees, or any other reason we deem necessary. We will provide notice when possible, except in cases of immediate security threats.
10. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.
11. Subscription and Billing
ATMA offers subscription-based access to its services:
- Free Trial: New users receive a 10-day free trial period
- Subscription: After the trial, a monthly subscription fee applies ($29.99/month)
- Payment: Subscriptions are processed through Stripe and automatically renew monthly
- Cancellation: You may cancel your subscription at any time through the billing page
- Refunds: Refund policies are as stated at the time of purchase
Failure to maintain an active subscription may result in loss of access to premium features. You remain responsible for any trades executed before subscription expiration.
12. Notifications and Communications
ATMA provides various notification services:
- Email Notifications: Account-related emails (welcome, password resets, daily forecasts) sent via Zoho Mail
- SMS Notifications: Trade notifications, daily forecasts, and account alerts sent via Twilio (standard message rates may apply)
- Discord Notifications: Trade updates sent to your Discord server via webhook URLs you configure
You can manage notification preferences in Settings. By providing your phone number or email, you consent to receive these communications. You may opt out of non-essential notifications at any time.
